Domestic violence battery can also involve an offense upon a minor child. Common battery offenses include hitting, biting, pushing, strangling, pulling on someone’s clothes or hair or throwing an object at another person.
Many different defenses exist for fighting charges of battery domestic violence, including arguments that the defendant acted in self-defense, that the altercation was an accident or that the “victim” is giving false accusations.
In some situations, the individual who is said to be the “victim” actually assaulted the defendant first, causing the altercation. In Nevada, individuals have the right to fight back if they believe it is necessary to avoid immediate bodily harm or death to either themselves or another person.
However, the defendant has to have used no more physical force than is necessary to protect himself or herself, meaning the defendant cannot use deadly force unless necessary, to protect himself or herself.
One exception to this rule involves the battered person’s syndrome, which is a condition that drives many domestic abuse victims to seriously harm or even kill their abusers. The battered person may strike out even when there is no immediate threat of harm, including when the abuser is asleep.
However, when there has been a strong history of abuse, the evidence can be presented to support a battered person’s syndrome self-defense claim. It should be noted that this defense is a fairly narrow situation.
Occasionally, a battery may occur by accident. In these situations, the person who caused the injury and is accused of battery may not be criminally liable.
If an injury occurs because of an unforeseeable accident, a defense can be raised to support the fact that the injury was not intentional and does not qualify as domestic violence battery. This defense is commonly used to reduce charges to a lesser offense, such as disturbing the peace.
Another defense that may be raised in domestic violence battery situations is the victim making false accusations. Sometimes, a person wronged in a relationship may resort to this type of accusation to get the other person in trouble. Others have gone as fair as causing self-inflicted wounds to back up their allegations.
Proving that the victim is making false accusations can be tricky. An expert may be needed to distinguish between true injuries and self-inflicted ones. Witnesses to what happened will almost always be needed, if possible. Testimony discrediting the alleged victim will always be needed, as well, including testimony impeaching the victim’s credibility in court.
